Australian Consumer Law guarantees

Under the Australian Consumer Law (ACL) a consumer has specific rights in regard to the purchases and services they acquire. These are automatically granted and do not have to be purchased. The ACL guarantees that all goods:

  • are of acceptable quality
  • match the description, sample or demonstration model
  • are fit for their disclosed purpose
  • come with clear title, unless otherwise stated
  • do not have undisclosed securities
  • come with a right to undisturbed possession
  • will have spare parts and repairs available for a reasonable amount of time after purchase unless otherwise stated
  • with express warranties, are honoured
  • When goods fail to meet a guarantee, a consumer has a right to a ‘remedy’ - an attempt to put the situation right. Depending on whether it is a major or minor failure, a consumer may be entitled to a repair, replacement, refund or compensation.

Consumers are guaranteed that services will be:

  • provided with due care and skill
  • fit for any disclosed purpose
  • completed within a reasonable time

Additional guarantees

The following types of warranties are in addition to the rights awarded to consumers under the ACL:

  • Warranty against defects (manufacturer’s warranty)
  • A warranty against defects is given by the manufacturer – it is commonly known as a 'manufacturer’s warranty'.
  • It says when you are entitled to a repair, replacement, refund or something else if the product has defects. These are additional to your legal rights to a refund, repair or replacement under consumer guarantees; not instead of. 

Store or manufacturer responsibility

When goods fail to meet a consumer guarantee, you have the right to a ‘remedy’ - an attempt to put the situation right.
Common remedies include repair, replacement, or to take action against the supplier for a refund, compensation or damages.
The supplier has to provide the remedy when goods:

  • are not fit for purpose
  • do not have clear title
  • do not have undisturbed possession
  • do not have any undisclosed securities
  • do not match a sample demonstration model.
  • The supplier is the person or business who sold, leased or hired the goods – for example, a retailer or a trader.
  • The manufacturer has to provide the remedy when repairs or spare parts are not available for a reasonable time after purchase.
  • The manufacturer is the person or business who:
  • made the goods
  • put the goods together
  • has their name or brand on the goods, or
  • imported the goods, if the maker does not have an office in Australia.
  • You can claim from the manufacturer or the supplier if goods:
  • are not of acceptable quality
  • do not match description
  • do not meet any extra promises made about them (express warranties).
  • Whether you are entitled to a repair, replacement, refund or other ‘remedy’ depends on whether the problem is a:
  • major failure
  • minor failure.
  • Consumer guarantees apply to both. When goods fail to meet a consumer guarantee, you may also bring an action for consequential losses – compensation for your costs in time and money because something went wrong. 

Company changes owners

If a business changes owners, the new owner must honour existing gift cards and vouchers if the business was:

  • sold as a ‘going concern’ (i.e. the assets and liabilities of the business were sold by the previous owner to the new owner)
  • previously owned by a company rather than an individual, and the new owner purchased the shares in the company.

Company goes out of business

If the company operating the business has been liquidated, the new owner may have only purchased the assets of the business and is not obliged to honour existing gift cards. In this situation, the consumer becomes an ‘unsecured creditor’ of the previous company.

Australian businesses and companies that trade online can include:

  • department stores and supermarkets
  • an individual who has a registered business or company, such as a jeweller with an online store
  • an individual selling items through an online auction house, such as eBay, who:
  • lists an ABN or company name in their advertising,
  • has a high volume of items for sale, or
  • has been trading for a number of years.

Your refund rights

You have the same refund rights as you do when buying from a physical shop. This means that, under the Australian Consumer Law, any item you buy is covered by ‘consumer guarantees’.
The business may also have its own refunds and returns policy with additional rights, such as offering a refund if you change your mind.

  • Problems, damage and non-delivery
  • If there is a problem with your product
  • If your product has not been delivered or was damaged in transit.
  • If you are having a dispute with the business.


The Dancing Years Terms & Conditions

Customers submitting a purchase order agree to be bound by the following terms and conditions set out The Dancing Years. The following terms and conditions supersede any previous terms and conditions and The Dancing Years reserves the right to make changes to the website and this document at anytime. If you do not agree to these terms and conditions, please do not use this site.


The Dancing Years does not accept liability for any loss or damages caused by this website, or any website linked to this website www.thedancingyears.com.au Reserves the right to refuse or cancel an order at anytime without giving reason. We will make all reasonable effort to contact the customer using the details provided and all received monies will be refunded using the method received.

Shipping within Australia

We cannot accept responsibility for delays in delivery due to unforeseen circumstances (eg: strikes, floods etc.). Online orders for delivery within Australia are dispatched and arrive within 5-7 working days from dispatch if any items cannot be fulfilled from your order we will contact you via email.

Acceptance of Goods

The customer is responsible for inspecting the goods for fault or damage and must notify The Dancing Years immediately. Goods may be returned providing the garments are unworn with tags intact and accompanied by the receipt. If you have received an item with a defect please email info@thedancingyears.com.au with your name, order reference and a description of the problem and we will resolve it as quickly as possible.


The Dancing Years reserves the right to change prices without notice. All prices and orders are displayed and processed in Australia Dollars (AUD) For overseas buyers, your credit card will be billed in Australian dollars and converted into the relevant currencies by your financial institution.
*The Dancing Years will take reasonable steps to verify that the order and credit details are bona fide.

Delivery Information

We would like to make your online shopping experience with us as enjoyable and hassle free as possible. If you have any questions in regards to ordering or a purchase you have made, please feel free to email or call us and we will do our best to assist you with your enquiries.

To guarantee delivery we recommend you send your parcel to your place of work, PO BOX or somewhere where there will be someone to receive it between 9am-5pm. If there isn't anyone at the residential address at the time of delivery a card will be left and your parcel will be redirected to the nearest post office.

We aim to get your order to you as soon as possible. Orders placed before 1pm (AEST) Monday to Friday, where stock is available at our online warehouse, will be dispatched the same day or next working day. Orders placed after 1pm (AEST) will be dispatched within 2 working days. During our busy sale periods please allow up to 2-3 days for your order to be dispatched.

  • You will receive your order in approximately 2 - 8 working days. During our busy sale periods please allow up to 14 days.
  • We must have correct and complete addresses, including a company name where necessary, and at least one contact telephone number.
  • We use Australia Post for deliveries.
  • In the unlikely case that an item you have purchased is sold out we will contact you so you can choose an alternative item or request a refund.
  • Please note that payment verification is required prior to us shipping your order. Depending on your payment method this may add a small delay to your shipping time.

We understand selecting the right style and size online can be a difficult one. For this reason, we welcome an exchange or full refund on online orders within 14 days of purchase provided the tax invoice can be produced, the original labelling is intact and items are returned in unworn condition.

To ensure you receive your preferred exchange choice please email info@thedancingyears.com.au  with your name, contact details, invoice number and details of the preferred replacement choice (Item name, colour & size). This will ensure your item is kept aside whilst we await the return of your garment to our Warehouse.

To return your preferred choice to you, a Postage & Handling charge will be applied once we receive the item you wish to exchange. We will contact you to process your payment, please ensure The Dancing Years has your best contact details. The Return and Exchange form sent to you with your invoice must be completed and returned with your garments.

The Dancing Years reserves the right to determine whether a product is faulty and conduct a production and quality check. If deemed faulty by The Dancing Years a replacement item will be shipped where possible subject to stock availability or a full refund including postage will be issued.

Please note:

  • The Dancing Years will not be held responsible if there is a delay in delivery.
  • Customers will be responsible for the return shipping and handling charge.
  • You need to send the original or a copy of receipt with you order.
  • In the event that your product is lost in transit, The Dancing Years will not be held liable and therefore recommends that you send all returns via Register Post.
  • We ask that you allow 7 business days from the day your return your package for your account to be credited.
  • All items must be returned within 14 days of original order.
  • Items have to be returned unworn, with original tags intact.
  • Due to health regulations we are unable to accept return of hair accessories, hosiery and undergarments unless deemed faulty or wrongly delivered.
  • Pointe and Demi Pointe shoes are final sale only and cannot be exchanged or returned unless deemed faulty or wrongly delivered.
  • All returns must be sent back via registered post.
  • Online purchases must be returned to the address below.
  • Returns / Exchange are to be processed through any of The Dancing Years retail store.
  • We cannot guarantee that the item you wish to exchange your purchase for will be available.
  • Refunds generally exclude shipping cost. If for some reason our quality control team missed a manufacturing fault or sent the wrong item, we will gladly provide you with a full refund (incl. shipping) or free exchange. The shipping cost will not be refunded on change of mind returns.

Order Cancellations

Orders may be cancelled only in the instance where the order has not yet been shipped.

Typographical Errors

In the event that an item is listed at an incorrect price or with incorrect information, The Dancing Years reserves the right to refuse or cancel orders.

The Dancing Years will make all reasonable effort to contact the customer using the details provided and all received monies will be refunded using the method received.

Colours shown on this website are representative only. All colours of garments are reproduced as accurately as possible, however a slight variation may occur in colour and size specifications. Colours may appear slightly different on the website due to computer picture resolution and individual monitor settings.
